[United States] Flying around eagles' nests

I'm gonna put this out there first: I in no way intend to harass eagles. I want to do some video of the river through town, and in scouting out the area, I found one of the more scenic and accessible sections has an active bald eagle nest sitting at the top of a big ol' sycamore right over top. Maybe 80-90 ft up. My question is: can I still fly under it, or do I need to find another section of river?
