Spent the last few weeks researching one of the most misunderstood areas in U.S. immigration:
**Part-Time H-1Bs.**
Most people assume H-1B = full-time only.
That’s actually not true.
I put together this visual breakdown after digging through:
DOL wage rules
USCIS memos
concurrent H-1B structures
FY2027 lottery changes
cap-exempt pathways
material change requirements
green card implications
Some things that surprised me:
• Part-time H-1Bs are legally valid
• Multiple concurrent H-1Bs are possible
• Universities/nonprofits create strategic cap-exempt options
• FY2027 wage-weighted selection could massively favor higher wage levels
• Switching FT ↔ PT can trigger amendment requirements
• “Benching” rules still apply even for PT workers
One especially interesting angle:
A senior-level professional working reduced hours may still qualify for high prevailing wage levels — which could become strategically important if the FY2027 weighted lottery system moves forward.
I tried turning all of this into a single infographic because most explanations online are either:
overly legalistic
incomplete
or straight-up inaccurate
Curious what people here think:
Have any of you actually done a concurrent PT + FT H-1B setup?
Do you think wage-weighted selection will fundamentally change H-1B strategy?
Would startups begin using fractional executive models more often?
Feedback welcome.
(And yes — not legal advice.)
