Divorce or post nup agreement
Hoping to get some insight. I, sahm from Texas have been told by my spouse that we either get divorced and he promises to make it a blood bath for me or he will work things out with me ONLY if I agree to a post nup. He claims he will not take the post nup and “file” the moment I sign that be just needs some security after all I’ve put him thought. (I accused him of being in a same sex relationship after I realized he was giving his male coworker way too much attention), was I wrong ofc. But he’s cheated before (emotionally and I stayed never asking of such document). His post nup terms are as followed:
-Primary custody (he’s adamant on child living with him even though I homeschool our son and I’m currently the primary caregiver).
But will “allow” us both to still have 50/50 which in Texas that doesn’t even sound possible.
-He will take all the marriage debt mind you I have no debt it’s all under his name.
-His wanting me to sign over the deed to him of our home bc he plans to “give it to our son as equity once he’s old… our son is 9. We purchased our home 5 years ago with a 20-30yr loan.
He said we will go to his lawyer and that I should trust him.
Sounds insane I know I’m completely against it. My question is— would a lawyer even agree to draft up such crap and if I do decide to sign I have text messages where he is pressuring me to sign or get divorced and has gone as far as contacting a lawyer (5 min conversation) saying it’s going to be 10k and he assures him a divorce where he gets custody and the house. Mind you I’m the only parent actively involved he’s not around aside from financially providing he doesn’t even help with feeding our son.
I’m at loss for words and now debating on filing for divorce bc I can’t come to terms even accepting a post nup so one sided any advice ? Thank you
