Renting Out Your Flat While Living Abroad: Legal and Property Management Guide for NRI Property Owners in India
Rohan Mehta had been living in Pune for the past eleven years when his family relocated abroad for work in early 2014. Before leaving, he owned a well-maintained two-bedroom flat in Gomti Nagar, Lucknow. The plan was simple: return within a couple of years and either sell or rent it out. That return never came. By March 2024, the flat had been sitting vacant for nearly a decade — gathering dust, accumulating minor repair issues, and costing Rohan money every time he flew back to India to sort things out personally.
Rohan had tried once, around late 2021, to engage a local acquaintance to manage the property and find a tenant. That arrangement fell apart within three months. No proper rent agreement was drafted, maintenance wasn't tracked, and the prospective tenant backed out after a dispute over notice period terms. Rohan was back to square one, increasingly frustrated, and unsure of his legal standing as an NRI landlord.
He approached Advocate Sudhir Rao's office in April 2024, looking for clarity on two things: his legal options for engaging a professional property manager, and how to structure a legally sound tenancy agreement that would protect him even from 8,000 kilometres away. A properly drafted Power of Attorney, a structured Leave and Licence Agreement under the Transfer of Property Act, 1882, and a clear engagement letter with a Mahindra Lifespace-affiliated property management firm were put in place within six weeks. The flat was tenanted by mid-June 2024. No more wasted trips to Lucknow.
