EWS Certificate Rejected Over Rented House Possession? Know Your Legal Rights

Rohan Verma, a resident of Gomti Nagar, Lucknow, was applying for an EWS (Economically Weaker Section) certificate in early March 2025 to support his admission to a postgraduate programme. He had carefully read through the DoPT guidelines and FAQ documents before initiating the process and was confident his family qualified. The Revenue Inspector at the local tehsil office, however, raised two successive objections that nearly derailed his application.

The first objection concerned undivided ancestral property belonging to his grandparents. Rohan correctly pointed out DoPT FAQ Question No. 4, which clearly states that undivided ancestral property does not count as family assets for EWS purposes. After considerable back-and-forth, the Revenue Inspector accepted this position.

The second objection proved harder to shake. Rohan's family lived in a rented house in Indira Nagar, Lucknow. The Revenue Inspector argued that the EWS criterion excludes families who "own or possess" a residential flat of 1,000 sq. ft. or above — and since Rohan's family was "possessing" the rented premises, she insisted on measuring it and threatened rejection if the area crossed the threshold. Rohan was understandably confused. He approached Advocate Sudhir Rao after his own attempts to persuade the official had failed and after receiving conflicting information from a local practitioner who was unfamiliar with administrative and service law matters. With a clear reading of the DoPT notifications, the Transfer of Property Act, and the legal distinction between ownership and permissive possession under a lease, Advocate Sudhir Rao prepared a precise written representation on Rohan's behalf. The Revenue Inspector's objection was formally set aside, and the certificate was issued by late March 2025.
