Government Employee Loan vs Insurance Claim: What to Do When the Bank Refuses to Settle

Ramesh Pillai was a state government employee working as a driver in Odisha for over two decades. In early February 2025, he took a top-up pension loan of approximately Rs. 8.5 lakhs from his pension-linked account maintained with Punjab National Bank, bringing his total outstanding loan to nearly Rs. 12 lakhs. Barely six weeks later, on 22 March 2025, he passed away due to a cardiac arrest, leaving behind his wife, Savitri Pillai, and two young children.

After his death, the pension credit account was transferred to Savitri's name as per the applicable government rules. A loan recovery agent then visited their home in Bhubaneswar's Sahid Nagar locality, telling Savitri that unless she continued paying monthly EMIs, the family's claim for the state government employee group insurance benefit, worth up to Rs. 10 lakhs, would not be processed. Frightened and grieving, Savitri paid EMIs for three consecutive months out of her own pocket.

When she finally approached the Deputy Branch Manager for a formal loan settlement using the expected insurance proceeds, she was told flatly that no loan insurance had been attached to the pension account loan, and that the settlement would require a lump-sum payment of roughly Rs. 5 lakhs. She had already spent months paying EMIs under pressure she never should have faced.

By the time the family approached Advocate Sudhir Rao, they were financially drained and legally confused. An earlier attempt to resolve the matter through a local general practitioner had yielded no concrete result, as the procedural angles specific to banking disputes and government insurance entitlements were not fully understood. With a structured legal approach covering the Consumer Protection Act, RBI guidelines on fair lending, and the applicable state government insurance scheme rules, the matter was taken up formally. The bank's conduct was scrutinised, the coercive recovery pressure was documented, and the family's entitlements were clearly established before the appropriate forum.
