Instagram Account Permanently Disabled for False Reasons — Legal Remedies in India

Priya Menon, a content creator based in Pune, had spent nearly six years building an Instagram presence of over 15,000 followers. She used the account professionally — posting lifestyle and home décor content, collaborating with brands like Fabindia and Nykaa Fashion, and steadily growing her audience. Around 18 March 2025, she woke up to find her account permanently disabled. The reason shown: "fake account."

That label was simply wrong. Priya had done nothing that violated any policy. What she had noticed, in the weeks before her account was taken down, were several deepfake and impersonation accounts copying her content on the platform. She had reported each one. None were removed. Her real account was.

She tried the in-app appeal process and even contacted Meta's support channels. Every attempt was dismissed. The response cited "severity of the violation" and refused any further review, giving no specific reason due to "privacy." Within days of creating a new account to stay in contact with her audience, that account too was suspended within 48 hours under the same "fake account" rationale.

A colleague recommended she consult Advocate Sudhir Rao. Previous attempts, including a general consumer complaint and repeated grievance emails, had gone nowhere. A structured legal approach, combining a formal grievance to Meta India's Grievance Officer, a notice under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and preparation for a Consumer Commission filing, produced a concrete response from the platform within weeks. The matter moved forward after that — something the earlier unstructured efforts had not achieved.
