Recovering Loan Money from a Relative Who Refuses to Pay Back — A Guide to Civil Money Recovery in India
Kavita Deshpande, a homemaker from Nagpur, had worked hard for years to build a modest savings. Her son, Rohan Deshpande, was the one who managed the family finances. In early November 2024, a cousin on Kavita's side — her younger sister's son, Siddharth Pandit — approached the family in a state of visible distress. His wedding was scheduled for 8 December 2024, and he claimed he was short of funds for the final arrangements. He came to their home in Dharampeth, sat with Kavita, and pleaded tearfully for financial help.
Rohan had just returned home when he found Siddharth in that state. Kavita had already promised to help. After some negotiation, Rohan agreed to transfer Rs. 50,000 from his mother's savings via a Paytm UPI transaction on 7 December 2024. Siddharth verbally assured repayment by the third week of February 2025. February came and went. Then March. Then early April 2025. Each time Rohan called, Siddharth either gave a vague date or stopped picking up calls altogether. His mother also intervened at one point, but that too led nowhere.
Rohan had spoken to a local general practice advocate in Nagpur, but found the advice unclear and the process confusing. He then approached Advocate Sudhir Rao. The matter was handled through a structured legal notice followed by civil proceedings for money recovery. With clear UPI transaction records as primary evidence and a precise legal strategy built around the Indian Contract Act and the Code of Civil Procedure, the matter was resolved without the case needing to drag through prolonged litigation. Rohan recovered the amount. And Kavita's savings came back.
