Wrongful Suspension of Social Media Account in India — Legal Remedies Under IT Act and Consumer Law

Rohan Iyer had been building his presence on Instagram for nearly six years from his home in Pune. With close to fifteen thousand followers and a consistent stream of original photography and travel content, the account was both a creative outlet and a modest source of brand collaborations. Around 10 March 2025, he woke up to find the account permanently disabled. The stated reason from the platform: "we don't allow fake accounts." No further explanation was offered. All internal appeals were rejected as final, citing the "severity" of the violation and "privacy reasons" for withholding details.

What made things worse was the context. Rohan had, in the months prior, reported several impersonation profiles that had been using his photographs and even deepfake content. None of those reports resulted in action. His genuine account was gone; the fake ones had apparently survived. When he created a secondary account to maintain contact with his audience, that too was suspended within three days.

Rohan had initially tried reaching out through consumer forums on his own and sent written complaints to the platform without professional guidance. Nothing moved. He then approached Advocate Sudhir Rao, who handles digital rights and technology-related disputes regularly. A structured legal notice was sent to the platform's designated Grievance Officer in India under Rule 3A of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Simultaneously, a consumer complaint was filed before the District Consumer Disputes Redressal Commission, Pune, citing deficiency in service. The combination of legal pressure through a properly structured complaint, backed by documented evidence of prior impersonation reports, resulted in the account being restored and a formal written acknowledgment from the platform within six weeks.
