Home Loan Prepayment Date Changed by Bank Without Consent — Know Your Legal Rights
Rohan Gupta, a mid-level software professional based in Nagpur, had taken a home loan from Kotak Mahindra Bank in late 2021. When that division was subsequently merged with the bank's broader retail lending arm in early 2023, bank representatives assured Rohan that the prepayment process would be streamlined — something closer to what Canara Bank offered, where borrowers could deposit prepayment amounts into a dedicated account in small installments at their convenience.
That promise never materialised. By March 2024, Rohan found himself stuck with an opaque online system that required him to email a written request, after which a single-use net banking link was sent. If that link failed or expired, the whole process had to restart from scratch. When Rohan visited the Sitabuldi branch in Nagpur with a cheque for a partial prepayment, the branch staff accepted it — but quietly revised his EMI due date to the 5th of the following month. His salary credit typically landed around the 22nd. The revised due date created a recurring shortfall window, and two EMIs bounced in quick succession, attracting penalties.
Rohan had already sent two written complaints to the bank's grievance cell without any substantive response. He approached Advocate Sudhir Rao after those efforts yielded nothing. A formal notice was issued under the Consumer Protection Act, 2019, backed by documented evidence of the bank's unilateral change and the resulting financial harm. The matter was filed before the District Consumer Disputes Redressal Commission in Nagpur, and the bank, faced with a well-constructed legal challenge, agreed to restore the original EMI due date and waive the bounce penalties. Acting through an advocate with specific experience in banking and consumer matters made a material difference — both in framing the legal issue correctly and in the speed of resolution.
