Can a Landlord Force You to Vacate for Paying Full Rent Online Instead of Part Cash?
A salaried professional working at a mid-sized firm in Pune had been renting a 2BHK apartment in the Kothrud area for nearly two years. The registered rent agreement clearly stated that monthly rent was to be transferred to the landlord's bank account on or before the 5th of each month. Nothing in that agreement mentioned cash payments of any kind.
Informally, the landlord had verbally asked the tenant to split payments — part online transfer, part cash. The tenant had been accommodating this request without question. Then, around 8 March 2025, the tenant travelled to Nagpur on urgent work for several weeks. Unable to arrange a partial cash payment from out of town, he transferred the full rent amount digitally to the landlord's bank account — exactly as the written agreement required.
The landlord's reaction was swift. He called the tenant and demanded he vacate within one month, citing violation of an unwritten "arrangement." No formal written notice was issued. After that call, the landlord stopped responding to calls and messages entirely. The tenant had a ₹50,000 security deposit at stake, a valid agreement running until late 2026, and no written complaint against him on record.
He'd initially tried reasoning with the landlord through a mutual contact, which went nowhere. When he came to Advocate Sudhir Rao's office, the matter was approached methodically: a legal notice was served under the Transfer of Property Act, 1882 and the Indian Contract Act, 1872, clearly asserting the tenant's right to continue occupancy and demanding written acknowledgement of the rent payment already made. The landlord, faced with a properly drafted legal notice, withdrew the verbal eviction demand and resumed communication. The deposit remained intact, and the tenancy continued as per the original agreement.
