Salary Account Frozen by Bank for Credit Dues — Legal Rights and Remedies in India

Rohan Gupta, a salaried employee working with a mid-sized logistics company in Pune, approached our office in late February 2025 after facing a deeply distressing situation. His salary account with a well-known private bank had been placed under a full debit freeze on account of an outstanding credit lien of approximately five lakh rupees. He was, by any measure, the sole earning member of his family, supporting his wife, two young children, and an elderly parent.

No written notice before the freeze. No formal demand letter under the loan agreement. When Rohan contacted the bank's branch in the Kothrud area of Pune, he was simply told to pay 2.5 lakh rupees upfront to get the freeze lifted — take it or leave it. He'd consulted a general civil lawyer before reaching our office, but that earlier attempt didn't result in any concrete action against the bank. The matter stayed stuck.

Once he brought the matter to us, a formal legal notice was issued to the bank under the relevant provisions of the Banking Regulation Act, 1949, and the Reserve Bank of India's circular on fair practices for lenders. A representation was simultaneously filed with the Banking Ombudsman, Pune. Within approximately three weeks, the bank agreed to a structured repayment arrangement and lifted the debit freeze on his salary account. The matter required a precise understanding of RBI guidelines, contractual rights under the loan agreement, and the specific procedural steps before the Banking Ombudsman — details that made all the difference here.
