Tenant Rights When Landlord Demands Vacation After Rent Hike Agreement — What the Law Says

Kavita Reddy had been renting a two-bedroom flat in Gomti Nagar, Lucknow for over three years without any dispute. Around early March 2025, her landlord contacted her over WhatsApp asking whether she wished to continue for the next rental term. Kavita confirmed she wanted to stay. The landlord then proposed a rent increase of roughly eighteen percent, and Kavita accepted in writing over WhatsApp the same evening.

Then things changed fast. Barely ten days later, the landlord sent another message asking Kavita to vacate the flat by the end of March 2025, citing the need for "major repairs." The flat was in perfectly sound condition — no seepage, no structural cracks, no safety concern of any kind. Kavita suspected the landlord simply wanted to rent the flat to a new tenant at a higher rate and was using repairs as a cover.

She first approached a local general practitioner advocate who sent a basic reply notice, but the landlord ignored it entirely and grew more aggressive. Kavita then reached out to Advocate Sudhir Rao, whose work in tenancy and property disputes gave this matter a different direction. A properly drafted response grounded in the UP Urban Buildings (Regulation of Letting, Rent and Eviction) Act, along with a Section 89 CPC-backed mediation strategy and a concurrent application before the Rent Control Authority, put the landlord on the back foot. The eviction demand was withdrawn, and Kavita continued her tenancy on the agreed revised rent.
