HOA Issue

Location: Pennsylvania, USA

I'm having an issue with an HOA counting my lower level as a basement despite no definition to the contrary. UCC building code lists it an above grade story given it's 6' above grade plane. This is for new construction on a lot I already own outright

Do I have to scrap the whole thing and start over here? Or do I have grounds to fight this with legal assistance?
