PSA: Relax, K-1 Visa Holders. The new USCIS "Leave the Country to Get a Green Card" Policy Memo DOES NOT Apply to You.
Hey everyone,
There is a ton of misinformation spreading across immigration subreddits right now because of the new USCIS policy memo that dropped last week.
I’m seeing a lot of terrifying posts claiming that everyone applying for Adjustment of Status (AOS) now has to go back to their home country for consular processing.
If you are currently on a K-1 fiancé(e) visa, or are about to enter the US on one: Take a deep breath. This does not apply to you. You do NOT need to leave the country to get your Green Card.
Here is why K-1s are completely safe from this new rule:
- K-1 visas are literally designed for US-based adjustment
The whole legal point of a K-1 visa is to enter the US, get married within 90 days, and file Form I-485 to adjust status from inside the United States. Congress literally wrote this pathway into immigration law. A USCIS policy memo cannot overwrite federal law.
- The memo targets tourist/student visa "loopholes"
USCIS is explicitly cracking down on people who enter the US on temporary, non-immigrant visas (like B-1/B-2 tourist visas or F-1 student visas) with the secret intention of staying and getting a Green Card right away.
The K-1 is a "dual-intent" visa. You already went to a US embassy abroad, took a medical exam, and proved your intent to immigrate. You didn't trick anyone at the border, so the logic of this new crackdown doesn't apply to you.
- AOS is your only legal option
If you enter on a K-1, you legally cannot switch to a student visa, work visa, or any other status. Your only legal path to permanent residency is adjusting status based on your marriage to your petitioner. Because it's your only available pathway, USCIS cannot deny it based on this new discretionary memo
