What do you think of the real state of this card?

Hi !

Ordered a Pokemon card from a professional seller, bought it for 35€, listed as EX.

My gf told me that the side might have been altered, as if the seller or the previous owner inked the bump. As we red the Cardmarket listing conditions we saw that something that has been inked should be listed as poor, no matter the whole state of the card.

I'm waiting for the seller to tell me if he's OK with refunding a part of it but I doubt he will be OK for it to be refunded as if it the state was poor.
