39 country ban is endless
39 countries — I actually think we’re not being pessimistic enough. Reasons:
- No concrete upcoming hold removal dates: We waited for Edlow’s “90-day memo” and that has now come and gone with nothing to show for it. No new timelines; we’re just “waiting.”
- The pause is now tied to the Presidential Proclamation: At this point, I genuinely think we need to wait for Trump to save us from Stephen Miller. Unless Trump (the only person that Miller listens to) changes that PP, these people will continue to falsely claim that’s the reason this ban exists.
- Court injunctions are not even moving the needle: Hacking and McBean filed lawsuits and won injunctions, yet EADs and APs are still not moving. That’s terrifying. If even successful litigation is not meaningfully changing outcomes on the ground, then what exactly is the mechanism for relief here?
- Stephen Miller: I’ll just say this - do your own research into this man and you’ll understand why many of us have absolutely no reason to be optimistic.
- Presidential immunity: With the Supreme Court’s ruling on absolute immunity and Trump’s preemptive pardons of his staff, these people have ammunition to willfully defy court orders.
Honestly, I feel until one of three things happens - a massive class action ruling against USCIS, Trump removes countries from the list, or something truly horrific happens to one of these families and it reaches national attention, widespread voters and Trump’s desk - people will remain stuck in limbo indefinitely.
And to the people who take pleasure in the suffering of immigrants: understand that many of these people have lived here for decades. They built careers here. Families here. Entire lives here. “Just go back” is extremely complicated and difficult. Remember the golden rule: do unto others as you would have them do unto you. One day, life will put you in a position where you need the same empathy you refused to give others. I guarantee it.
