Moving To Spain Help

Hi can someone tell me if I can convert from a Non Lucrative visa to a digital nomad visa? I talked to a lawyer and she said that I couldn’t since I have to sign a letter saying I won’t work for that year and that I would be breaking that oath since in order to get the DM visa I have to prove three months worth of salary payments. Is this correct?
