Season 6 Episode 17 the smoking gun. Did they or didn’t they?

Ok so I’ve been rewatching from the start and it’s my second time at this scene of whether or not James and Kristen hooked up in Jax’s hot tub and what stands out to me each time is how Schwartz James Kristen we’re all getting wasted together but somehow James and Kristen end up and Jax’s but Schwartz somehow gets lost and ends up at an entirely different resort. Since that’s his usual mode of alibi it leads me to believe he was intentionally distancing himself from any foul play to escape any fallout. Schwartz blacks out way too often for me to believe it’s conveniently every time something scandalous goes down.
