Anyone experienced with losing a family member to "accidental death: drug use" under the 2 year timeframe and getting their full payout?

Family member was in physical therapy for years and on the day of discharge, died. Paid for all of their services and support for years, etc and need to know how to get compensation. had no idea they were using or I wouldn't have been so generous. I did think to get the policy but it hasn't aged and there is an exclusion for drug related death. i think I just get a refund but wondering if there's a possibility to appeal. Ive seen things get approved via health insurance off the policy, any chance here?
