What happens to your child's special education rights when they turn 18 — the age of majority transfer under IDEA
Most parents navigating the IEP process focus on the K-12 years. But there's a transition that happens at 18 — or 21 in some states — that catches a lot of families off guard if nobody has explained it.
Under IDEA, when a student with a disability reaches the age of majority in their state — typically 18 — the procedural rights that belonged to the parents transfer to the student. That means the student, not the parent, becomes the primary decision-maker for their own special education program.
What this means in practice:
The school must notify both the student and the parents at least one year before the student reaches the age of majority, explaining that rights will transfer. That notification is legally required.
Once rights transfer, the student receives all the notices and documents that previously went to the parents. The student must consent to evaluations, IEP changes, and placement decisions. The parent's signature is no longer sufficient.
There is an exception. If a student has been determined to be incompetent under state law, the rights do not transfer. In that case, a guardian or other representative continues to hold decision-making authority. The process for this varies by state.
Parents can still be involved — the student can give the school permission to continue sharing information with parents. But the default changes. Without that permission, the school is not required to keep parents informed.
One thing worth doing well before your child turns 18: have a direct conversation about what this transition means, what decisions they'll be making, and what kind of involvement you'll both want to maintain. Some students are fully ready to take the lead. Others benefit from a gradual handoff. Either way, understanding what's coming makes it less disorienting for everyone.
Has anyone navigated this transition with their child? Did the school notify you in advance?
