Made to use up sick leave while pending accommodation review
Location: Maryland
TLDR: Can employers force an employee to use up sick and safe leave while pending review of an accommodation request?
Hello! Is it perfectly normal to be made to use up my sick leave while employers gather information on my accommodation request? I had a seizure, informed my supervisor, [saw the doctor, sent the dr letter to HR and returned to work.--same day]. Mid meeting I was told to clock out and that my SSL/PTO will be charged till they can sort out my reasonable accommodation request.
My letter expressed i could work from home but I'll admit it was confusing how the dr wrote it. It said i should be allowed to work from home for 90 days (I can't drive for that time) and I should be allowed to wfh during my eeg which takes 3 days at home. Thing is, I was already wfh the day they sent me home and sched to wfh the following day. Fortunately I can walk to work so I don't need to wfh for 90 days and my employers know this. I had the dr fill out the accommodation paperwork where they clarified I am able to work in the office and shld be allowed to wfh during the eeg.
Obviously my frustration is that im perfectly capable of working, it says so in the letter, but my ssl is being wasted.
Hr found the change in language concerning they said and are awaiting further response from my dr before letting me work. All this while my ssl is being completely drained.
One aspect of my job does require occasional driving so while I completely understand removing me from work those days I don't understand why I was removed on those 2 wfh days especially.
I've documented everything best i can in email but hr would only tell me anything in a virtual meeting I was not allowed to record.
I genuinely just want to understand the policy or law behind these decisions but they have been incredibly resistant to answering such questions. Can anyone help educate me?
