Small Claims Court - Vehicle Curbsider

Anyone here have experience with purchasing a car from someone who turned out to be a Curbsider?

I bought a vehicle last summer, and at the time, everything checked out. a couple days later, while doing the oil change, they noticed the oil was topped up a lot, and that the engine had a rod knock noise.

I didn’t hear the rod knock, the mechanic said because the oil was higher than it should have been it lubricated it so u couldn’t hear the knock.

Looking back at the security footage, u could hear a slight noise but it wasn’t crazy.

The mechanic said the engine was finished.

I found out shortly after that the person was a curbsider, operating out his house. he had sold many cars claiming it was his brother in laws or sisters etc.

OMVIC verified this, i have documentation.

Omvic said i may have a civil case against him, so i served the person papers and he didn’t respond within the 20 days. it’s actually been creeping on 3 months now.

Do i have a case?
