Questions from a first-time documentary filmmaker
Hi everyone, I have been involved with films for more than 13 years - always fiction on all past projects, so I know a lot but I understand with documentary films, some things are going to be different.
Obviously, an E&O policy is a must because I plan on using some footage that is Copywritten photos and footage - and of course I realize that I need proper licensing in place to use those things.
But here's where I'm confused. This film IS in many respects, educational as we're presenting new research via the interviews, but due to it being such a highly marketable subject matter, I would love to be able to sell it to a streamer after the festival fun. So, then it becomes commercial.
Here's my question. When it comes to licensing some footage, pictures, and 1 or 2 songs, while in festivals, well, it's not me profiting - it only becomes 'for profit' once a streamer gets involved...
I had one licensing quote, on one of the songs, where they gave me a lower price for the song during the festival run. But they added it would go up to a commercial rate once the streaming began.
Then on some very key footage, well, they gave me a different answer, as long as the film is educational - it's free and also, I can use it in festivals and asked for no money during this period.
Obviously, I'm confused. And my question is, are the licensing needs/costs changing as I go through the various stages - is that it works in this world?
Lastly, I certainly will consult with an entertainment attorney for clarity but meanwhile, I just wanted to see if anyone here might know about such things - thanks.
