Two active cases: I-730 ( derivative asylum) pending + EB-3 AOS
Hello everyone, has anyone dealt with a parallel immigration pathway situation?
I see many posts about pending asylum cases being approved alongside employment- or marriage-based AOS.
In my case, I have a derivative asylum application (I-730) that was filed in 2024 and is still pending. At the same time, my employer filed my EB-3 AOS in 2025 and have already received my EAD and Advance Parole from the EB-3 application.
I went for the interview, and the main concern of the officer was: 'Why did you file EB-3 if you still have a pending asylum derivative case?' The officer told me I would have to choose one pathway because they were concerned about having two active cases at the same time which ultimately leads to same the permanent residence.
Has anyone else experienced something similar?
