LMIA Based Work Permit

My brother's closed work permit is expiring on June 21. His employer is willing to sponsor him again and has already applied for Lmia.

If Lmia is not finalized by June 21, of course they are not able to apply for work permit.

Say he applies for visitor record and hopefully once his employer gets positive Lmia, can he apply for work permit while he already has a visitor record application?
