Can/should I take a debt collector to small claims court for non-returned overcharge? (UT)

Small Claims Procedure

Earlier this year, I was being garnished through my employer for an old debt through a debt collector. Once the debt was fully paid, I received a full paycheck, and then the next was garnished AGAIN ($400). It seemed as though they filed a back-dated document claiming that I still owed when I did not.

I talked with HR and the collector directly about this, and was told it would be returned to me once it was refunded through my employer’s payroll provider. It has now been over 90 days and it still has not been returned. They are unresponsive towards my company’s HR. I called again today and they claim that it was sent to my old address and returned, I had to directly ask them to update to my new address and was told “IF it’s returned to us we will resend it…”

They have been pretty scummy to deal with from the start and am worried I’ll continue to be strung along. I have documentation and recorded calls. This has also affected me as the unexpected loss from the paycheck resulted in late payments. Would really appreciate any advice here.

Bonus tid-bit: This debt was from getting my wisdom teeth out as a teenager. My dad paid for that, but I didn’t go to the follow-up appointment and was charged $150, which was eventually sold off to a collector where I was subsequently sued. As a dumb teen, I didn’t go to the court hearing, figuring the amount was such a small amount that I didn’t care. That amount blew up to nearly $2000 from interest by the time they finally started garnishing me :) DON’T DO THAT!!
