The wife and I closed on this home in March of 2024 in Pennsylvania. It was a new build from a local builder. He did offer a one year post purchase warranty for any issues that arise.
Clearly we are over 2 years now, however I feel as if this issue is bigger than a standard 1 year warranty should cover.
About 3 weeks ago I noticed a small amount of water trickling down the left side of our window that faces the right side of the house when it rains heavy. I did some digging and noticed it came in from the top portion and was slipping down to the left, running down the wall.
Now fast forward to 3 days ago and I noticed that a piece of siding fall off the very top of that same side of the house right above the window. I thought immediately that was a weird coincidence. As the pictures show the frame of the house has zero water proofing wrap on it. Now that’s clearly a huge issue as to keeping any side ways rain from potentially getting behind the siding and down the frame. Which can and could have already resulted in mold and structural damage.

I reached out to the builder, he claims he will send his son out to come check it out sometime this week or next when he gets time, clearly not an urgent matter to him or he has little care thus far. I am willing to contact a construction attorney and go forward with their help if need be.

My question here is, how hard do I push this builder to come out sooner? if the builder decides to claim this isn’t their fault, would it be best to go through my home owners insurance in the mean time to get a fix remedy, while I get with a attorney?

Thank you for your time.
