International Travel
Hi all, Need your guidance and on my situation.
Context:
Upcoming International travel: June 26 - July 8
Current H1B validity: Nov 5
Current stamp validity: Nov 5
My H1B extension process was supposed to be completed well before my travel, but due to unforeseen delays, it has not been completed yet.
Question:
Is it okay and safe to proceed with the travel given my circumstances and H1B validity and initiate the extension process once I am back to the US?
Reason:
From my understanding, if they initiate the extension when I am in US and it gets approved while I am out of country, it could cause potential trouble while returning, so I asked my employer attorney to initiate the extension process once I return to the US.
The attorney firm has agreed to it and just asked me to send the updated i94 once I am back as they continue to work on the extension petition and have everything ready when I come back.
Which makes me think they have given the go ahead with the travel, but I just wanted to get confirmation from a broader forum and also check if there’s any nuance I am missing.
Thanks in advance!
