card evaluated as HP by a possible buyer

so i got this "ortega (219/197)" that came significantly darker than a normal card is, it is NM because i tought that it could have more value as it has an fabrication error. so i got it to sell with a bunch other cards, and the buyer said that it was HP because of the paint thing. is he right or wrong?
