B2 Denied, H1B Pending: Should I leave now to avoid 222(g) visa voidance?
My B2 COS was denied, and my H1B COS is still pending. I also have a valid H1B visa stamp until Sep 2027.
Since the $100k fee is not an issue right now, I’m trying to understand. If I depart the U.S. now, and later my H1B is approved with I-797B (consular processing), would that be the safer path in my case?
Main concern: if I stay and COS is denied, could that create a 222(g) visa voidance issue, whereas leaving now might protect my current stamp and let me re-enter later with the approval notice?
Would appreciate thoughts from anyone who has dealt with a similar situation.
