VA Mortgage Trapped in Loss Mitigation Cycle

We are hoping to get guidance from anyone familiar with VA mortgage servicing, foreclosure defense, or loan modification processes. We fell behind on our VA-backed mortgage about a year ago. At the beginning of this process, we were told we would likely qualify for a loan modification. However, once the modification process began, our loan was instead placed into repeated forbearance cycles, and we have remained stuck there ever since.

Key issues:

We were initially told a loan modification was possible

Instead, we were placed into forbearance repeatedly, rolling from one period into another

We have never signed a forbearance agreement, only discussed terms over the phone

Each time a forbearance period ends, we are restarted into another loss mitigation application instead of being reviewed for a permanent solution

Our loan balance continues to increase through this cycle

We were also told there is a “title issue” preventing approval of permanent loss mitigation, specifically referencing a judgment lien.

However:

The judgment lien is not actually ours

It appears to be an identity mismatch (same first and last name as another individual)

We have already submitted documentation to the servicer showing the error and incorrect identification

Despite this, we are still being told the title issue remains unresolved, without clear documentation or explanation or timeline.

This is a VA loan, and we are trying to understand:

Can a servicer continuously cycle a borrower through forbearance without a signed agreement or clear resolution path?

What are our rights when a “title issue” is asserted but not documented or explained?

How are identity-error judgment liens typically corrected in servicing or title review?

At what point does this become a RESPA / CFPB complaint or require legal intervention?

Is it normal for loss mitigation to restart repeatedly instead of moving toward a permanent modification decision?

We are not refusing to pay; we are trying to resolve this and get back into a sustainable payment structure. Right now, we feel stuck in a loop without transparency or a clear path forward.

If anyone here is a mortgage attorney, VA servicing specialist, or has dealt with similar situations, we would really appreciate any guidance on what steps to take next.
