Someone please reassure me

Home Insurance

Memorial Day weekend the drain on my neighbor’s porch backed up and flooded my living room in my condo (the other side of my living room wall is the outside wall of my neighbor’s porch). I filed a claim with my insurance (State Farm) and had a water mitigation company out who took part of my living room wall and my LVP floor. The LVP can’t be matched, so they took the entire floor of my condo. There was about $2k in personal property damage.

Important note: it’s the HOA’s responsibility to keep outside drains clear- which they weren’t, I have it in writing from the board president that he couldn’t remember the last time it was done. The drain on the porch travels ~20 feet and empties into a larger pipe that spans the length of the entire building (5units) before emptying out on either side of the building.

Today, I get a call from my claims adjuster who says I may not be covered because it wasn’t my pipe that caused the flood. The discrepancy we are having is because if the drains empty into a master pipe, I’m covered, but there is a chance I’m not because the flood originated next door and it is the HOA’s responsibility.

Half my stuff is in boxes, half isn’t, but it’s all sitting on the concrete slab. It looks like a trap house. I can’t leave the house like this, let alone pay the mitigation people. Technically I could put it on a credit card or take out an equity line to pay for it, but I’m in a wheelchair and on a fixed income, so I will never financially recover from this.

If I’m not covered, what do I do? Go after the HOA insurance? I’m loosing my shit because I absolutely did not want this. I moved to Ohio from Florida, so I know about flood insurance and made sure have the flood endorsement and over-insure myself with a name brand insurance. It wasn’t properly explained to me that the flood endorsement only covers my drains. I’m more than a bit irritated with my agent because I explicitly told him I absolutely did not want to be in the position and to build me the most robust policy he can and charge me whatever.

What’s my next steps? How screwed am I?
