Ben is basically just giving BAM the entire Go Fund Me by defending himself in court

If Ben is committing to defending himself in court, which it seems like he is, he's going to be found guilty on all charges. One of those is the claims that his Go Fund Me is illegal and the money belongs to BAM. That means Brian Mansell will not get the money, Brian will not be able to sue and get his LEGO/reparations, and everyone he got to donate to it has been suckered into giving their money to the company they were told the Go Fund Me existed to defend against.

Basically, Ben is turning a slam dunk win into the worst possible outcome for everyone involved, including his viewers who selflessly gave the Mansell family money.
