From the article:

>The [Summary Offences Act 1981](https://www.legislation.govt.nz/act/public/1981/113/en/latest/#DLM53353) already contains offences covering disorderly and offensive behaviour. Police can direct groups engaged in threatening or disorderly conduct to disperse and can require people to stop obstructing public rights of way, with failure to comply carrying its own penalties.

>It therefore might be asked whether the Government is genuinely trying to “fix the basics” – or is simply playing politics at the expense of some of society’s most marginalised people. \[...\]

>What is clear, however, is that the bill rejects a focus on homelessness as primarily a social problem and returns to the Victorian notion that homeless people are to be managed as a public nuisance through criminal justice powers.

The last part is the crucial part. Although the intent of the bill is claimed to be about disorderly behaviour (already covered in other legislation), this is a very slippery slope. This bill could effectively criminalise homelessness.

A video went viral a few years ago from a US state with laws similar to this. It was of a homeless pregnant woman in labour on a mattress under a bridge with her partner. Her contractions were obvious but police continued to claim she was faking it. They eventually called her an ambulance but not before issuing her with a charge and fine for 'street camping' despite the woman and her partner repeatedly explaining they had been making their way to hospital and were only resting there because she was in labour. They charged a homeless woman with a criminal offence for using a mattress on the side of the road to rest while in labour. That's the scenario this kind of law lays foundations for and that's not OK.
