Higher level review with attorney

I hired an attorney and he claimed there is merit in doing a higher level review for my sleep apnea claim it was supplemental secondary to my ibs and anxiety. Is there any chance I can get an approval this time around if the attorney says there is merit? I have a cpap prescribed already
