Can I take Flipkart to Consumer Court for repeated delivery failures and mental harassment? (Second occurrence in a few months)

Legal Advice Needed

Hi everyone,

I'm looking for legal advice regarding a repeated issue with Flipkart.

This is unfortunately the second time within a few months that I've had to escalate a delayed delivery of a high-value order to Flipkart's Grievance Officer.

The first incident involved a Sony PlayStation 5, where Flipkart delayed delivery by several days despite repeatedly marking the order as "Out for Delivery." After numerous calls, emails and a grievance escalation, the order was eventually delivered.

I assumed it was an isolated incident.

Unfortunately, the same thing has happened again.

Current Order

Product: OPPO Find X9 Ultra (Approx. ₹1.4 lakh)

Order Date: 20 June 2026

Promised Delivery: 22 June 2026

Timeline

22 June

  • Stayed home the entire day waiting.
  • No delivery.
  • No proactive communication from Flipkart.

23 June

  • Order marked "Out for Delivery."
  • Waited the entire day.
  • Delivery executive ignored multiple calls.
  • Customer support also struggled to contact him.
  • Eventually I was told another delivery executive would handle the exchange.
  • Customer support assured me the order would definitely be delivered on 24 June.

24 June

  • Stayed home again.
  • No delivery.
  • Tracking status barely changed.
  • No explanation.

25 June

  • Customer support informed me the phone had only recently reached the Patancheru Hub and would not be delivered that day.
  • I requested permission to collect the phone directly from the hub since it was already there.
  • I was refused and told to wait another 24 hours.

Throughout this period I have received little more than scripted responses from customer support.

The delivery executive ignored calls.

No one has been able to provide an accurate delivery timeline or take ownership of resolving the issue.

I have now spent four consecutive days rearranging my work schedule and remaining at home waiting for a ₹1.4 lakh phone that Flipkart repeatedly assured me would be delivered.

I have already:

  • Escalated the matter to Flipkart's Grievance Officer.
  • Received Complaint ID: IN26062317582881431877
  • Preserved screenshots, chat transcripts, WhatsApp messages, order tracking history and email correspondence as evidence.

My Questions

  1. Does this amount to deficiency in service under the Consumer Protection Act, 2019?
  2. Since this is the second time Flipkart has subjected me to an almost identical experience for a premium order, does that strengthen my case?
  3. Can I claim compensation for:
    • Mental harassment
    • Loss of time (having to remain home for four consecutive days)
    • Deficiency in service
  4. Should I first file a complaint with the National Consumer Helpline, or proceed directly to the Consumer Commission through e-Daakhil?

I'd appreciate advice from anyone who has successfully pursued a similar case against Flipkart or another e-commerce platform.

Thank you.
