Title: Appeal pending but execution and possession scheduled – bona fide purchaser in Haryana property dispute. What are my options?

Legal Advice Needed

I am seeking general legal opinions on a property dispute in Haryana.

I purchased a residential plot/house through a registered sale deed after verifying the documents.

At the time of purchase, I had no knowledge of any dispute and I consider myself a bona fide purchaser.

I have been in possession of the property. I have an electricity connection in my name and independent local witnesses (including an ex-Sarpanch, neighbours and a milkman) who can testify that I have been in possession.

Later, the original owner (Mukesh) filed a civil suit claiming that the earlier transaction with Mahender was obtained by fraud/coercion.

The Trial Court decided against me and declared the subsequent sale deeds invalid.

I have filed a first appeal before the District Judge. The appeal is still pending, but no stay has been granted yet.

Meanwhile, the execution court has issued a possession warrant, and the Naib Tehsildar has issued a notice to deliver possession with police assistance.

I also have a document where Mukesh allegedly wrote that no amount was due after the transaction, which I believe contradicts his later claims.

My lawyer says that at this stage we can request the Tehsildar for some time, but execution may still proceed.

My questions:

  1. If I am ultimately held to be a bona fide purchaser, what relief can the appellate court grant?

  2. If possession is taken during execution, can I get the property back if I later win the appeal?

  3. Is there any realistic way to obtain urgent interim protection when execution is imminent?

  4. Has anyone dealt with a similar situation in Indian civil courts?

I am looking for general legal guidance and similar experiences, not specific legal representation.
