Anyone dealt with Property Card for old Co-op Society flats?
Hi everyone,
I'm looking for guidance from Gujarat property lawyers or anyone experienced with Ahmedabad property transactions.
Facts:
- Property is a flat in a Cooperative Housing Society in Maninagar, Ahmedabad.
- Originally purchased in 1993 in my grandmother's name.
- She passed away in 2013 without a will.
- Her legal heirs were 5 daughters and 1 son (my father).
- In 2015, all 5 daughters signed documents relinquishing their rights in favour of my father. (The documents are notarized; I'm trying to understand whether that is sufficient or whether they should have been registered.)
- The society transferred the share certificate/member records into my father's name.
- There has never been a Property Card for this property.
- We now want to sell the flat.
A lawyer has told us:
- Stamp duty needs to be paid on the allottee/member/share certificate.
- Property Card needs to be created before sale.
My questions are:
- Can a cooperative society flat in Ahmedabad be sold if no Property Card has ever been issued?
- Does the law require the Property Card ownership history to first be created in my grandmother's name, then all six legal heirs, then again mutated solely to my father after the sisters' relinquishment?
- Or can the City Survey directly issue/mutate the Property Card in my father's name based on:
- Original purchase documents,
- Death certificate,
- Legal heir proof,
- Relinquishment documents,
- Society records?
- If the 2015 documents are only notarized and not registered, what is the correct legal procedure today before selling?
I'm looking specifically for guidance under Gujarat law and any practical experience with Ahmedabad City Survey/Sub-Registrar offices.
Thanks in advance!
