Laid off on H1B - best path (H4, EAD, or new H1B) to maintain status and minimize gaps?
Hi all, looking for some guidance on my spouse’s immigration situation after a recent layoff. We want to maintain lawful status and minimize any employment gaps.
Background:
Spouse was laid off on June 16, 2026 (currently on H1B)
H1B validity: Oct 1, 2021 – Jan 2, 2027
Would need an extension to cover the remaining time until Sept 30, 2027
I have an approved I-140
-
Maintaining lawful status
What’s the safest option for continuous status?
File Change of Status (COS) to H4 immediately, OR
Try to find a new H1B employer within the 60-day grace period. -
H4 + H4 EAD options
We’re considering:
Option A: File H4 COS now, apply for H4 EAD later (possibly post-dated)
Option B: File H4 COS + H4 EAD together and start working once approved
Questions:
Is a post-dated H4 EAD filing even possible/recommended?
From a risk and timing perspective, which option is better? -
Using the remaining H1B time
If my spouse switches to H4 now, can they later return to H1B without going through the lottery?
Any risk of losing remaining H1B time if switching to H4 and back? -
PERM & green card strategy
Given my approved I-140:
What’s the best approach for starting or continuing PERM for my spouse?
Should we:
Move to H4 EAD first, then start PERM, OR
Try to stay on H1B for PERM continuity?
Are there timing or risk differences depending on H1B vs. H-4 EAD?
Thanks in advance for any guidance!
