VA Effective Date

Higher-Level Review (HLR)

Good morning, everyone. I’m wondering whether anyone has had a similar experience or has advice on how I handled this.

In April 2025, I filed an Intent to File, which the VA acknowledged.

- In October 2025, I submitted the claim.

- In December 2025, the claim was denied.

- I then gathered additional evidence, including witness statements and a private nexus letter/DBQ.

- In April 2026, I filed a supplemental claim for the denied condition.

- In June 2026, the VA granted the claim.

However, the VA assigned a lower rating from April 2025 to April 2026, then assigned the higher rating beginning on the date of the private DBQ in April 2026. Because of that, my higher overall combined rating did not begin until April 2026.

I filed an HLR and opted out of the informal conference. I also submitted a written argument explaining that I had continuously pursued the claim and that the DBQ did not state that my worsened symptoms began on the date of the examination. My position is that the DBQ documented the severity of symptoms that were already present rather than establishing the date they first worsened.

I understand that staged ratings can be assigned, but I’m confused about why the VA used the DBQ date as the effective date for the higher rating when the examination did not identify that date as the onset of increased severity.

Has anyone dealt with a similar staged-rating or effective-date issue? Did an HLR correct it, or did you have to pursue another appeal option?
