Buying a house in Arkavathy BDA layout. Legal is 100% clean but site has 5ft extra on the ground. Is it Safe to proceed?
Hey guys,
Looking for some advice from anyone who understands BDA layouts or Bangalore real estate quirks. I’m currently looking at an independent G+2 house in Arkavathy Layout.
We got the legal verification done through a proper lawyer and even cross verified with the BDA office directly. The papers are completely clean, no court cases, no litigation, everything is on track.
But here is the catch. On paper (deed and Khata), the site is a standard 30x40. But physically on the ground, the building is built on a 30x45 footprint. The owner says he got an extra 5 feet at the back. There is a big apartment complex right behind this house, and apparently when they built their compound wall, they left some setback space. The independent house builders on this lane just pushed their back walls forward to touch the apartment wall.
We visited the site and it's actually true—literally every single plot on that entire row has extended out by the exact same 5 feet to meet the apartment wall. The problem is, the actual concrete rooms and balconies of this house are built using that extra 5 feet.
The owner itself stated that there is extra 5ft that they got .
A few questions:
- Will nationalized banks (like SBI or HDFC) reject the home loan during physical inspection because the actual building is 30x45 but documents say 30x40? Or will they just fund it based on the 30x40 value?
- Can BBMP or BDA create issues later down the line (like during drone mapping or random checks) even if the entire street has done the exact same thing?
- Is this a common thing in Bangalore that I should just accept, or is it a major red flag despite a clean title?
