I'm involved in a contested divorce and custody case. My attorney recently withdrew, and I applied through Legal Action/Judicare for replacement counsel. They ultimately declined to appoint another attorney because they believed my previous attorney's withdrawal was reasonable under the circumstances. I'm not looking to dispute that decision. I'm trying to determine my next legal steps.
I have limited financial resources and had planned to use my share of our joint tax refund to retain private counsel. That refund is currently in dispute as part of the divorce, so I don't have access to the funds I expected to use to hire an attorney.
My final pretrial is approaching, and I'm actively contacting private attorneys, but so far I haven't been able to secure representation.
My questions are:
- Would it be reasonable to file a motion requesting a continuance so I have additional time to obtain counsel?
- If so, what information should generally be included in that request?
- Are there Wisconsin legal aid organizations, nonprofit resources, or court-related resources that assist people in situations where their attorney has withdrawn and replacement counsel could not be obtained?
I'm looking for procedural guidance and information about resources that I may have overlooked. Thank you.
