Disability Concern
I had a tbi in September 2024 and am fighting for disability. I’m 37 and have a solid employment record. I have so many cognitive deficits, vision issues that my optometrist said I can’t legally drive or take public transportation alone. I have had 8 surgeries in total including an unsuccessful work attempt.
The concern is I stupidly got drunk in an isolated incident after learning about my ex wife’s suicide. And was taken to the hospital 2 days before my 8th surgery since I was asleep in the entry way to my apartment after losing my building key.
I have never been drunk while recovering from my disability outside of that. I’m worried that my judge will determine that drinking is a material reason for my disability now.
Will that incident negatively impact my disability case? Im at the ALJ stage with attorneys.
Did the ALJ judge contact your former employers?
Any thoughts would be appreciated.
