Male/Transgender victims need to be taken seriously
The laws in our country concerning sexual assault are extremely discriminatory. The definition of rape legally, specifically places the perpetrator as a male and a victim as a female.
Consequently, female on female, male on male, and female on male sexual assaults cannot be prosecuted.
The complete ignorance of transgender victims is also abhorrent. Law doesn't even recognize same sex marriage.
There was IPC 377 which could be invoked in cases of male on male non-consensual sexual assault, as male on male intercourse was against the order of nature - but when we shifted to BNS in 2024. The IPC 377 was entirely dropped off the penal code.
Even, POCSO is yet to be ruled as gender neutral by the Supreme Court.
The act meant to protect children, isn't protecting them.
Once in a while I hear arguments that these laws are made because women are raped at a higher rate than men. Obviously they will be because we define rape to be male on female. Consider forced penetration, an obvious non-consensual sexual assault - which basically means the victim is forced to penetrate the perpetrator.
