Title: PH Legal Advice: My co-worker secretly accessed my phone, read old private conversations, and is now using them against me. What are my legal rights?

Hello everyone, especially lawyers, HR practitioners, or anyone knowledgeable about Philippine labor laws, the Data Privacy Act, or government employment.

I’ve been overthinking this for months, and I honestly don’t know what the proper course of action is. This incident has caused me a lot of anxiety, and I would really appreciate any legal advice or guidance.

For context, I am a permanent government employee.
Around a year ago, I accidentally left my cellphone at the office after work. At that time, I didn’t think much of it because my phone was protected by a passcode. Looking back, however, I realized that my passcode was my birthday, which could probably be guessed by someone who knows me personally.
I never received any notification that someone had attempted to access my phone, and I had absolutely no reason to believe anyone had opened it.

Fast forward several months later.

One of my co-workers, whom I also considered a friend, suddenly confronted me and claimed that I had been “smearing” him behind his back. I was honestly confused because I didn’t understand where these allegations were coming from.
The matter eventually reached our HR office. During the discussion, HR asked him how he learned about these alleged statements.

To my surprise, he openly admitted that he had accessed my cellphone one time when I accidentally left it in the office. He admitted that he opened my phone and read my private conversations without asking for my permission or informing me afterward.

What disturbed me even more was the specific conversation he mentioned.
The messages were not recent. They were old private chats between me and one of my closest friends from several months earlier (within the same year). They were buried among many other conversations. Because of this, I genuinely find it difficult to believe that reading them was merely “accidental.”

To reach those messages, it seems he would have had to intentionally unlock my phone, open my messaging app, select a specific conversation, and then scroll through months of messages—or possibly even use the search function—to find what he was referring to.
This is what keeps bothering me.
I don’t know the extent of what he accessed.
I don’t know if he only read that one conversation.
I don’t know if he opened my conversations with other people.
I don’t know if he viewed my photos, emails, documents, banking apps, social media, notes, or any other confidential information stored on my phone.

The uncertainty has been mentally exhausting because I have no way of knowing how much of my personal information was exposed.

To make matters worse, he is now using information he obtained from my private conversations to accuse me of speaking negatively about him. He claims that I also told other office mates similar things, which I strongly dispute. I am worried these allegations may damage my professional reputation, affect my standing in the workplace, or even be used against me administratively.

I understand that what I privately tell a close friend may not always be flattering, but those were personal conversations that I never intended anyone else to see. They were not public posts, official reports, or workplace communications. They were private messages on my personal phone.

Because of everything that has happened, I constantly feel anxious whenever I’m at work. I no longer feel comfortable around this co-worker because I keep wondering what else he may have seen or shared with others. It’s also difficult knowing that someone I trusted intentionally accessed my personal device without my knowledge.

These are the questions I’d like to ask:

  1. Does unlocking someone else’s phone without permission and reading their private conversations amount to unauthorized access or a violation of the Data Privacy Act, the Cybercrime Prevention Act, or any other Philippine law?

  2. Can he realistically claim that reading those messages was merely “accidental,” considering the conversation happened months earlier and would have required scrolling through old messages?

  3. Does it matter legally that he later admitted to HR that he had accessed my phone?

  4. Since I don’t know everything he accessed, is there any legal way to determine the extent of the intrusion?

5.As government employees, could this also constitute administrative misconduct or conduct unbecoming of a public servant?

6.Should I file a written complaint with HR, report the matter to our agency head, seek assistance from the National Privacy Commission, or consult a lawyer first?

  1. Would it be wiser to document everything now in case this escalates later?

  2. Lastly, this incident has severely affected my mental well-being and sense of safety at work. Would resigning be advisable, or would that simply weaken my position if I decide to pursue a complaint?

At this point, I’m not looking to retaliate or create conflict. I simply want to understand whether my rights were violated, what remedies are available under Philippine law, and what the most appropriate next step would be.

Any legal insights or advice would be greatly appreciated. Thank you for taking the time to read.
