The U.S. Department of Justice has warned Milwaukee officials that the city's ordinance restricting federal law enforcement officers, including ICE agents, from wearing face coverings while interacting with the public is unconstitutional. In a letter signed by First Assistant U.S. Attorney Brad Schimel and Assistant Attorney General Brett Shumate, the DOJ argued that the ordinance interferes with federal immigration enforcement and violates the Constitution's Supremacy Clause, which gives federal law precedence over conflicting local laws.

The DOJ said the rule could endanger federal officers, hinder immigration operations, and create conflicts between local and federal authorities. The department demanded assurances by **July 17, 2026**, that Milwaukee would not enforce the ordinance against federal officers, warning that legal action could follow if the city refuses.

Milwaukee officials defended the ordinance, saying it was designed to improve transparency, accountability, and public trust by requiring officers interacting with the public to show their identities. Supporters argue the measure helps residents distinguish legitimate officers from impersonators, while opponents maintain it unlawfully regulates federal agents carrying out their duties.
