Can a condo building remove or sanction an owner after these events?
Location: Illinois
I’m looking for legal information about a situation involving a condo building in Illinois and what the options are for evicting an owner. I’ll use John and Jane as fake names.
Background: John and Jane were involved in multiple domestic violence incidents. After one incident in which John extensively damaged her residence, the condo building’s board banned John from the property, and Jane filed an order of protection against him.
A few days after the building banned John, residents spotted John in the building over the weekend, but those who saw him didn't know there was a ban in place.
A couple of days later, John returned to the property with a weapon. When a member of the building told John that he needed to leave, John killed that individual (not Jane).
Jane is an owner in the building (not a tenant/renter), and many residents are understandably upset and concerned about safety. Many individuals in the building believe the board should take action against her because she knew he was dangerous and she invited John back after he had been banned.
Questions:
- Can a condo association take action against an owner who invited a banned person back before a homicide?
- If Jane knowingly invited John onto the property despite the building ban and her order of protection, could that expose her to any criminal or civil consequences?
- Would the police go through John's phone to see text messages? I'm curious to see if there are messages between John and Jane, and to see if she invited him over for the weekend after the ban was put in place.
