Can i Go for Uncontested while Having OOP
I have a few questions regarding my case in Saratoga County, New York.
I currently have a full stay-away Order of Protection against my husband. If I sign an uncontested divorce agreement outside of court, how could that affect my Order of Protection? Could signing the uncontested divorce have any impact on the protection order or my legal rights? What kinds of issues could I face in the future if I sign it?
If I decide not to sign the uncontested divorce, how could that affect my case? My husband does not own a house, real estate, or any significant assets. As far as I know, his only substantial asset is his retirement account, and his income is approximately twice mine.
Regarding the Order of Protection, if the case goes to trial and my husband wins (meaning the Order of Protection is dismissed or not continued), what legal or practical consequences could I face? Could that affect my divorce case, my rights, or any future legal matters in New York?
I would appreciate an explanation based on New York law, specifically Saratoga County.
