advice for getting hit as a pedestrian by a cyclist
On June 19, I was walking down Lakeshore (on the shared bike/walkway) and a cyclist on a Tangerine bike came from behind me and crashed into me (my left leg, specifically)!
She said she'd pay for the bills and would like to go through court, and I'm pretty sure she doesn't have insurance.
I've gotten billed from the hospital, and she isn't picking up any of my calls or responding to my texts, even though she said she would cover the ambulance and any hospital fees, since she wanted to ensure that I was "actually injured" (I had a knee sprain and an ankle sprain, and was given crutches for a while).
I've called her from my phone, and two other phone numbers, one of which she picked up and then hung up immediately.
I also reported it to Divison 14 police already, and they said that she didn't write a report yet (even though when she left the site of the accident, she said she was going directly there).
I've called many injury lawyers, all who don't want to take on the case (I presume because it's unknown if she has insurance, most likely she doesn't).
She did breach negligence, with no duty of care, that led to the damages (my leg). Also, I was not able to go into work for a month (my supervisor had my shifts covered until July 23). I also missed the Arkells show and the Hotelier show that weekend because of this.
What can I do in the court of law?
